DECLARATION ON THE PROCESSING OF PERSONAL DATA

These terms of the operator of the website www.novaetvetera.cz, which is the company NOVA ET VETERA, s.r.o., with its registered office at Náměstí Jiřího z Poděbrad 1554/6, 130 00 Prague 3 – Vinohrady, ID No.: 09492615, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 336618 (hereinafter referred to as the "Operator"), contain information related to the processing of personal data that is submitted and processed in particular in connection with the use of the user inquiry service, where a user submits an inquiry regarding the Operator's offer through a form on the Operator's website (hereinafter referred to as the "User").

The Operator's website and the offers published thereon are not intended for persons under 18 years of age.

The Operator declares that personal data is collected and further handled in accordance with the rules set out below, in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), as amended (hereinafter referred to as the "Regulation").

Personal Data

Personal data is information that can uniquely identify the User, e.g. first name and surname, telephone number, postal or e-mail address, IP address, etc. The Operator collects only such personal data as the User knowingly makes available. For example, data provided when filling in the contact form on the Operator's website.

Automatically Recorded Information

When accessing the Operator's website, non-personal information is automatically recorded – type of internet browser, number of visits, average time spent on the page, number of pages visited – this information is not personal data. Based on this information, aggregated anonymised statistical lists are created, and this information is used to monitor traffic on the Operator's website, helping the Operator to improve the content and functionality of the site. The statistical lists do not contain personal data enabling the identification of individual Users.

Purpose of Processing of Personal Data

The primary purpose of processing personal data is to respond to the User's inquiry, or to handle their request; in such cases, the personal data is retained by the Operator for a reasonable period depending on the nature of the specific inquiry.

If a contract is concluded between the Operator and the User, the personal data will be used for the purposes of performance of such contracts (in particular reservation contracts, future purchase contracts, purchase contracts, or contracts on the transfer of ownership of a unit), and will be retained for the duration of these contractual relationships and subsequently for a period of 5 (five) years, unless a longer retention period is required by law; the legal basis for processing in this case is the concluded contract, and the provision of personal data is a contractual requirement. In such case, the legal basis for processing personal data shall be the concluded contract.

If the User gives consent, their personal data will also be used for the purposes of commercial and marketing communications, for the duration of their interest in receiving commercial messages. In such case, the legal basis for processing personal data shall be the User's consent.

The legal basis for the processing of personal data also includes the legitimate interests of the Operator (in particular for the purpose of records of contractual relationships and statistical purposes, for the purpose of protecting the Operator's rights against unlawful conduct, including IT security, and the enforcement of the Operator's receivables) and compliance with legal requirements (in particular compliance with the requirements of personal data protection regulations, accounting, and tax obligations).

Disclosure of Personal Data to Third Parties

The Operator undertakes that personal data will not be transferred to third countries or provided to international organisations or third parties with the exception of the following recipients:

• Companies belonging to the NOVA ET VETERA, s.r.o. development group, i.e. sister companies of the Operator and subsidiaries of the Operator.

Security

The Operator ensures the security of personal data; personal data is conscientiously protected against loss, destruction, distortion/falsification, manipulation, unauthorised access or unauthorised disclosure.

Rights of Users in connection with the processing of personal data

In connection with the processing of personal data, the User has the following rights vis-à-vis the Operator:

• The right to withdraw consent to the processing of personal data pursuant to Article 7(3) of the Regulation
• The right of access to personal data pursuant to Article 15 of the Regulation
• The right to rectification of personal data pursuant to Article 16 of the Regulation
• The right to erasure ("right to be forgotten") pursuant to Article 17 of the Regulation
• The right to restriction of processing pursuant to Article 18 of the Regulation
• The right to data portability pursuant to Article 20 of the Regulation
• The right to object lodged with the Operator pursuant to Article 21 of the Regulation
• The right to lodge a complaint with the supervisory authority, which is the Office for Personal Data Protection, pursuant to Article 77 of the Regulation
